1. Acceptance of Terms

Welcome to MashMore. These Terms of Service ("Terms") govern your use of the MashMore website ("Site"), your purchase of products from us, and any related services. By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Return Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Site, you represent that you meet this requirement and that all information you provide is accurate, current, and complete.

3. Account Registration

You may create an account to track orders and save preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at mashy@mashmorepotato.com if you suspect unauthorized access.

4. Products, Pricing & Availability

We try to display product colors, sizes, and details as accurately as possible, but cannot guarantee your device displays colors exactly as they appear in person.
All prices are in U.S. Dollars (USD) unless otherwise noted, and are subject to change without notice.
We reserve the right to limit quantities, refuse or cancel any order at our sole discretion (including if a pricing error or fraud is detected).
If we cancel a paid order, you will receive a full refund to your original payment method.

5. Orders & Payment

Placing an order is an offer to buy. We accept your offer when we send the order confirmation email.
Payment is processed at the time you submit your order, via Shopify Payments and supported methods (credit/debit cards, Apple Pay, Google Pay, Shop Pay, etc.).
You authorize us (and our payment processor) to charge the full order amount, including taxes and shipping.
Sales tax is collected where required by law based on the shipping destination.

6. Promotional Codes

Discount codes are valid for the period stated, on eligible items only.
One code per order unless otherwise stated.
Codes have no cash value and cannot be combined with other offers unless explicitly allowed.
We reserve the right to disable codes that are being misused (resold, bot-applied, etc.).

7. Shipping & Returns

Shipping terms are described in our Shipping Policy. Returns and refunds are described in our Return & Refund Policy. Both are incorporated into these Terms by reference.

8. Intellectual Property

All content on the Site — including the MashMore name, logo, Chef Mashy mascot, designs, photography, graphics, copy, and code — is owned by MashMore LLC or licensed to us. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission. Personal, non-commercial use of the Site is permitted.

9. User Content

If you submit reviews, photos, tags, comments, or other content ("User Content"), you grant MashMore a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and distribute that content for marketing and operational purposes, with attribution where reasonable. You represent that you own the rights to the content you submit and that it does not violate any third-party rights or applicable law.

10. Prohibited Conduct

You agree not to:

Use the Site for any unlawful, fraudulent, or harmful purpose
Attempt to gain unauthorized access to our systems, accounts, or data
Interfere with the operation of the Site (DDoS, scraping at abusive rates, automated bots)
Resell or commercially exploit products without our written permission
Use any automated means (bots, scripts) to place orders or apply promo codes

Violations may result in account termination and legal action.

11. Disclaimers

The Site and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as required by law. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, MashMore LLC and its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless MashMore LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Site.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Albany County, New York, and you consent to personal jurisdiction there.

Nothing in these Terms limits any non-waivable consumer rights under applicable law in your jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
